If a person has a horse taken away from him, and he finds him, he may lawfully seize him, but he cannot justify breaking open a stable, or entering on the grounds of a third person to take him, but must have recourse to a magistrate or to an action at law. If a purchaser of a horse, warranted to be sound, or of a certain age, discovers that he is not sound, or is of a greater age, and offers to return the horse to the seller, who refuses to take him back, the purchaser may sell the horse, and then maintain an action against the seller on the warranty. If a man takes a horse to grass, without any special promise to keep or redeliver him safe, and he is stolen, or if he stray, if the fences are good, and reasonable care be taken, the owner cannot sue for the horse.
